1.1 Agreement Acceptance: By joining our Affiliate Program, you agree to abide by these Terms of Service.
1.2 Program Description: Our Affiliate Program allows you to earn a commission on sales referred to Mubert Inc through your unique affiliate links.
2.1 Account Creation: You must provide accurate and complete information when creating your affiliate account.
2.2 Promotional Methods: Affiliates are expected to adhere to our guidelines regarding acceptable promotional methods. Unacceptable methods include spamming, misleading claims, or any form of false advertising. You can use the paid marketing activities, including Google Search Ads. However, please note that usage of branded keywords (mubert, mubert ai, mubert music, etc.) is strictly prohibited and will lead to account deletion. You can use keywords related to AI Music and Royalty-Free Music.
2.3 Compliance with Laws: Affiliates must comply with all legal requirements and regulations, including those related to marketing, privacy, and data protection.
3.1 Tracking Mechanism: We will provide you with unique tracking links. It is your responsibility to ensure these links are used correctly in your promotions.
3.2 Cookie Duration: The referral tracking cookies are valid for 60-days after the initial click-through.
4.1 Commission Rate: Affiliates will receive a 30% commission on qualifying sales.
4.2 Hold Period: The average Hold Period is 2-2.5 months.
4.2 Payment Schedule: Commissions are paid out monthly, without any minimum payout thresholds.
4.3 Payment Method: Payments will be made via PayPal.
5.1 Usage of Brand Materials: Affiliates may use our trademarks and branding materials as provided in the affiliate program. These materials must not be altered in any way.
5.2 No Ownership Claims: Affiliates do not gain any ownership rights over the company’s trademarks or any other intellectual property.
6.1 Voluntary Termination: Either party may terminate this agreement at any time with written notice.
6.2 Breach of Terms: We reserve the right to terminate your participation in the Affiliate Program immediately and without notice if you violate these terms.
7.1 No Warranties: We do not make any explicit or implicit warranties regarding the Affiliate Program.
7.2 Liability Cap: Our liability arising out of this agreement shall not exceed the total commissions paid or payable to you.
8.1 Amendments: We may modify any of the terms and conditions within this Agreement at any time and at our sole discretion.
8.2 Governing Law: This Agreement shall be governed by the laws of the United States.
8.3 Independent Contractor: You agree that you are an independent contractor, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between you and Mubert Inc.
